Delhi High Court Shields India Head Coach Gautam Gambhir in Rs 2.5 Crore Deepfake Case
The Delhi High Court has mandated major technology platforms, including Google, Meta, and Amazon, to immediately take down unauthorized content exploiting the identity of Indian men’s cricket team head coach Gautam Gambhir.
Justice Jyoti Singh presided over the single-judge bench, ordering the removal of flagged URLs and directing the platforms to disclose the Basic Subscriber Information (BSI) of the entities responsible for uploading the offending material. The court granted protection to Gambhir’s personality and publicity rights, halting the unauthorized commercial use of his likeness.
Coordinated Campaign of Digital Impersonation
Gambhir filed the plea in the Commercial Division of the Delhi High Court after his legal team identified a surge in fabricated content across multiple platforms, including Instagram, X, YouTube, and Facebook. The petition detailed how artificial intelligence tools were deployed to create misleading videos and endorsements.
The primary violations cited in the lawsuit include:
- Use of face-swapping and voice-cloning technologies to create viral, misleading videos for commercial gain
- Unauthorized sale of merchandise utilizing his name and photographs on Amazon and similar e-commerce platforms
- Severe reputational harm and professional risk concerning his current position with the Board of Control for Cricket in India (BCCI)
The lawsuit targets several social media intermediaries and e-commerce platforms, demanding a permanent injunction to restrain all defendants from using his name, image, voice, or persona without explicit consent. Gambhir is also seeking Rs 2.5 crore in damages for the digital impersonation.
